General terms and conditions

Article 1: Definitions

In these general terms and conditions the following definitions apply:

  • Provider: 24villas, part of 24nannies, located at Ridder van Cuykstraat, Boxtel, registered with the Chamber of Commerce under number 61277401.
  • Principal: The natural or legal person using the services of 24villas.
  • Guest: The person or persons using the accommodation offered by 24villas.
  • Services: All services offered by 24villas, including the rental of luxury villas and additional services.
  • Agreement: The agreement between Client and Contractor regarding the provision of services.
  • Written: In these conditions written also means electronic communication, such as e-mail, provided that the authenticity of the sender can be sufficiently established.

Article 2: Applicability

  • 2.1 These general terms and conditions apply to all offers, agreements and services of 24villas, unless otherwise agreed in writing.
  • 2.2 Deviations from these terms and conditions are only valid if agreed in writing between the contractor and the client.
  • 2.3 The general conditions shall also apply to all future legal relationships between the contractor and the client, unless otherwise agreed.

Article 3: Offers and Conclusion of the Agreement

  • 3.1 All offers made by 24villas are non-binding and valid for 14 days, unless otherwise stated.
  • 3.2 The agreement is established by written acceptance by the client of the offer or by the actual commencement of the services by 24villas.
  • 3.3 24villas reserves the right to refuse orders without giving reasons.

Article 4: Services

  • 4.1 24villas offers luxury villa rentals including additional services such as concierge services, cleaning, catering and transportation.
  • 4.2 The specific interpretation of the services is defined in the agreement between the contractor and the client.
  • 4.3 24villas endeavors to perform the services to the best of its knowledge and ability, in accordance with the agreements recorded in writing with the client.

Article 5: Rates and Payments

  • 5.1 The rates for 24villas’ services are stated in the offer and/or agreement and are exclusive of VAT, unless otherwise indicated.
  • 5.2 Payment must be made within 14 days of the invoice date, unless otherwise agreed in writing.
  • 5.3 In case of late payment Client shall be in default by operation of law and shall owe interest of 1% per month on the outstanding amount. In addition all judicial and extrajudicial collection costs shall be borne by the Principal.
  • 5.4 24villas reserves the right to index its rates annually. The client will be notified in writing of rate changes at least 30 days in advance.

Article 6: Cancellation and Changes

  • 6.1 Cancellation by the client must be made in writing.
  • 6.2 For cancellation more than 30 days before the start of the stay, the client shall owe 25% of the agreed amount.
  • 6.3 For cancellation between 30 and 14 days before the start of the stay, the client shall owe 50% of the agreed amount.
  • 6.4 For cancellation within 14 days before the start of the stay, the client shall owe 100% of the agreed amount.
  • 6.5 Changes to the booking can only be made in consultation with 24villas and are subject to availability.

Article 7: Liability

  • 7.1 24villas shall not be liable for any direct or indirect damages, including consequential damages, lost profits or immaterial damages, unless there is intent or gross negligence on the part of 24villas.
  • 7.2 24villas is not liable for damages caused by force majeure, such as natural disasters, acts of war, pandemics or other unforeseen circumstances beyond its control.
  • 7.3 The Principal/Letting Party is liable for damage to the villa and/or contents caused by the Guest or by third parties staying in the villa with the Guest’s consent.
  • 7.4 The Principal shall indemnify 24villas against all third party claims related to the execution of the contract.

Article 8: House Rules and Code of Conduct

  • 8.1 Guests must comply with the house rules as drawn up by 24villas, which will be made available upon arrival.
  • 8.2 Nuisance to local residents and damage to the accommodation or its contents is prohibited. In case of violation of the house rules 24villas reserves the right to terminate the agreement immediately without refunding any amounts already paid.

Article 9: Privacy and Data Protection

  • 9.1 24villas processes personal data in accordance with the General Data Protection Regulation (AVG). Please see our privacy policy for more information on how we handle your data.
  • 9.2 Both parties are obliged to keep confidential all confidential information obtained under the agreement.

Article 10: Complaints

  • 10.1 Complaints about the performance of the agreement must be submitted to 24villas in writing, stating reasons, within 7 days of the completion of the service.
  • 10.2 24villas will respond in writing within 14 days after receipt of the complaint. If a complaint requires a longer processing time, 24villas will send within 14 days a notice of receipt and an indication when the client can expect a more detailed response.
  • 10.3 If the complaint cannot be resolved by mutual agreement, a dispute arises which is subject to the dispute settlement as described in article 12.

Article 11: Changes to the Terms and Conditions

  • 11.1 24villas reserves the right to modify these terms and conditions.
  • 11.2 Amendments will be communicated to the client in writing at least 30 days before the effective date.
  • 11.3 If the Client does not agree with the amended conditions, it has the right to terminate the agreement in writing within 14 days after receiving the amended conditions.

Article 12: Applicable law and Disputes

  • 12.1 All legal relationships to which 24villas is a party are exclusively governed by Dutch law.
  • 12.2 Disputes will be submitted to the competent court in the district where 24villas is located, unless mandatory law provides otherwise.
